Terms of Service

1. Acceptance of Terms

By accessing or using ScriptMotion (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ScriptMotion is an AI-powered video generation platform that enables users to create video content using multiple AI models, guided workflows, and brand management tools. The Service includes video generation, client review features, brand kit management, and export capabilities.

3. Account Registration

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete registration information.

4. Subscription and Billing

The Service is available under various subscription plans with credit-based billing. Credits are consumed when generating video content. Subscription credits reset each billing cycle and do not roll over. Top-up credits roll over as long as the base subscription is active. All fees are non-refundable except as required by law.

Cancellation and Refunds

Annual plans are not refundable. Cancellation takes effect at the end of the current billing period. Monthly plans cancel at the end of the current billing period and are not refunded for the remainder of the period.

5. Content and Intellectual Property

You retain ownership of all content you upload to the Service (scripts, images, brand assets). You grant ScriptMotion a limited license to process this content for the purpose of providing the Service. Video content generated by the Service is owned by you, subject to the terms of the underlying AI model providers.

6. Your Content and Your Responsibilities

“Your Content” means everything you upload, submit, or otherwise make available through the Service, including images, photographs, likenesses, voices, scripts, brand assets, and any video or other output you generate from them. You are solely responsible for Your Content and for any consequences of uploading, generating, publishing, or distributing it.

By uploading or submitting Your Content, you represent and warrant that, at all times:

  • you own Your Content, or you have obtained and will maintain all rights, licenses, consents, releases, and permissions necessary to upload it, to generate content from it, and to grant the license set out in these Terms;
  • Your Content, and ScriptMotion's processing of it to provide the Service, does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity or likeness rights, moral rights, or any other right;
  • where Your Content contains, depicts, or is derived from the image, face, voice, or likeness of any real, identifiable person, you have obtained that person's explicit, informed, and freely given consent to that use (and, where required by law, in writing), and you can produce evidence of that consent on request;
  • you have not uploaded and will not upload any image, face, or likeness of a person under the age of 18, or of any public figure or other person, without the consent required above; and
  • Your Content does not violate our Acceptable Use Policy.

ScriptMotion does not pre-screen Your Content and is not responsible or liable for Your Content or for any content that any user uploads, generates, publishes, or distributes using the Service. We may, but are not obligated to, review, remove, refuse to process, or disable access to any of Your Content at any time, for any or no reason, in our sole discretion.

7. Acceptable Use

You agree not to use the Service to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable, and you agree not to upload the image, face, voice, or likeness of any person without that person's consent. See our Acceptable Use Policy for details. We are not liable for content that you or any other user creates, uploads, or distributes in violation of these Terms or that policy, and such use is strictly prohibited.

8. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ScriptMotion and its parents, subsidiaries, affiliates, officers, directors, employees, agents, partners, suppliers, and licensors (the “ScriptMotion Parties”) from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms or the Acceptable Use Policy; or (d) your violation of any law or of any right of any third party, including any intellectual property, privacy, publicity, or likeness right. This obligation survives termination of your account and these Terms.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Service and all content generated through it are provided on an “AS IS” and “AS AVAILABLE” basis, with all faults and without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. ScriptMotion does not warrant that the Service will be uninterrupted, secure, or error-free, that AI-generated output will be accurate, appropriate, non-infringing, or fit for any particular use, or that any defect will be corrected. You are solely responsible for evaluating, and for any decision to publish or rely on, any content generated through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, ScriptMotion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, and shall not be liable for any content created, uploaded, generated, published, or distributed by you or any other user. Our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amounts paid by you to ScriptMotion in the three months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).

11. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will continue until the end of the current billing period. ScriptMotion may suspend or terminate your account for violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
